Plaintiff seeks, inter alia, to add additional evidence to his complaint. However, I previously explained to him that the Court will only consider claims properly pled in a complaint or in a superseding amended complaint. The Court will not consider claims stated in notices or other pleadings that fail to comply with the Federal Rules of Civil Procedure. Additionally, I warned Plaintiff that an amended complaint renders the original complaint without legal effect. (Doc. No. 5 .) For this reason, his motion is denied. Plaintiff also seeks additional relief that is premature at this time. Plaintiff still has not complied with the Court's order regarding paying the filing fee or showing that he qualifies to proceed in forma pauperis. This case is about Captain Edwards, Lieutenant Ross, Sergeant Swindel and the unknown Doe Defendants, in their official capacities, allegedly subjecting Plaintiff to inhumane conditions of confinement including: (1) exposure to sewage, feces, blood, and black mold; (2) sleeping on concrete; (3) unsafe drinking water and inadequate nutrition; and (4) lack of adequate exercise and yard call. (Docs. No. 70, 75.) Rather than submitting information leading to serving the Doe Defendants, Plaintiff seeks to add the supervisory defendants that were previously dismissed. Nothing that Plaintiff states in his proposed amendment changes the Court's previous analysis. Plaintiff's conclusory allegations fail to state plausible claims against these defendants. Plaintiff's discovery requests included with his motion are overbroad and do not appear to help him identify the Doe defendants. Plaintiff's allegations stem from June 9 to September 9, 2024, so his discovery must be targeted within these dates. Additionally, Plaintiff's complaint gives little help to identity who are the Does and what exactly they did. Accordingly, his Motion is denied. Plaintiff should request information leading to the discovery of the Doe defendants within the time period of June 9 to September 9, 2024 and should state what each Defendant did, in what location of the jail, at what approximate time, etc. Plaintiff's request for more time is premature as I have already granted until September 1, 2026. I am unlikely to grant more time than this, as this matter needs to proceed, with or without the Doe defendants. Defense Counsel must answer discovery requests or object to them being not in conformance with the Rules of Civil Procedure. Additionally, since Plaintiff is no longer in custody, the Court requests Counsel and Plaintiff to meet and confer to attempt to identify who are the Doe defendants so this matter may proceed.
